I am MIKIO KISARA, legal name Mikio Kisara(木皿幹雄), and I have written and published The Turntable of Civilization on the Internet since July 16, 2010.
The name “Akutagawa Kenji(芥川賢治)” is a pen name that I formerly used.
Because I wished to avoid disclosing my legal name on the Internet, I personally created the pen name “Akutagawa Kenji(芥川賢治)” by combining “Akutagawa(芥川)” from Ryunosuke Akutagawa(芥川龍之介) and “Kenji(賢治)” from Kenji Miyazawa(宮沢賢治).
I also formally used “Akutagawa Kenji(芥川賢治)” as the author’s name of the book The Turntable of Civilization, published by Bungeisha on December 1, 2011.
Accordingly, “Akutagawa Kenji(芥川賢治),” as the author of The Turntable of Civilization, is a pen name that I, Mikio Kisara, personally created and actually used.
However, a profile or account exists on Facebook that uses the name “Akutagawa Kenji(芥川賢治)” without my permission and creates the misleading impression that it is connected with me or with the author of The Turntable of Civilization.
I am neither the creator, administrator, nor poster of the Facebook account in question.
Nor have I ever authorized any third party to use the pen name “Akutagawa Kenji(芥川賢治).”
This is not merely a case of two people having the same name or an accidental coincidence of names.
Before this Facebook impersonation appeared, I had already been subjected for many years to repeated search interference, unauthorized reproduction of my writings, impersonation, and defamation.
The origin of these acts dates back to June 1, 2011.
At that time, I was suffering from a serious illness, and my attending physician told me that my probability of survival was approximately 25 percent.
I spent approximately eight months in hospital.
From my hospital room on June 1, 2011, I announced that the book The Turntable of Civilization would be published by Bungeisha on December 1 of that year.
The unbelievable search interference began immediately after I made that publication announcement.
One individual created hundreds of IDs through several blog service providers and opened a large number of blogs containing incomprehensible and extremely poor-quality material.
That individual then reproduced chapters and passages that I had written for The Turntable of Civilization on those blogs without my permission.
As a result, especially the first through tenth pages of search results on Google and other search engines became filled with incomprehensible blogs, low-quality pages, and pages containing unauthorized reproductions of my work.
In 2012, I personally went alone to the police station with jurisdiction over the matter and filed a criminal complaint against this individual.
The criminal complaint was formally accepted, and a police investigation was commenced.
The investigating officer informed me that the person named in the criminal complaint had admitted creating numerous IDs and blogs and carrying out the series of acts himself.
Furthermore, in a civil action brought by the company that I managed against this individual, a judgment fully upholding our company’s claims was rendered and has already become final and binding.
Accordingly, I am not baselessly suspecting an unrelated individual.
We possess sufficient relevant documentation concerning this matter, including the final and binding judgment.
At that time, this individual created multiple accounts on Twitter, including an ID called “Akutagawa (芥川)+ Kenji(賢治)” (@masaya1865) and another ID containing the name “Djokovic.”
These accounts repeatedly published appalling defamatory statements to the following effect:
“Do you know the unscrupulous author named Mr. Kisara, also known as Akutagawa Kenji(芥川賢治)?”
“Do you know the unscrupulous real estate broker named Mr. Kisara, also known as Akutagawa Kenji(芥川賢治)?”
By deliberately connecting the pen name “Akutagawa Kenji(芥川賢治),” which I had formally used, with my legal surname, Kisara, this individual described me as an “unscrupulous author” and an “unscrupulous real estate broker” and attempted to damage my social reputation, my credibility as an author, and my honor as a company executive.
Then, around November 2017, a profile or account using the name “Akutagawa Kenji(芥川賢治)” appeared on Facebook.
We possess evidence showing that the large number of blogs and multiple Twitter accounts created from 2011 onward and the Facebook account using the name “Akutagawa Kenji(芥川賢治),” which appeared around November 2017, were created or managed by the same individual.
The materials in our possession include records of the blogs from that period, Twitter posts and accounts, the Facebook profile, search results, distinctive expressions, names used, connections among the accounts, chronological records, screenshots, and other relevant materials.
When necessary, I will submit to Meta my identity documents, a physical copy of the book The Turntable of Civilization and its publication records, records showing my use of the former pen name, documents concerning the criminal complaint, and records of the accounts described above.
This impersonation is not simply a matter of a third party using the name “Akutagawa Kenji(芥川賢治).”
There is a strong suspicion that the individual who defamed me as an “unscrupulous author” and an “unscrupulous real estate broker” subsequently assumed my own pen name and created on Facebook a false identity, photographs, personal relationships, and activity history entirely unrelated to me.
Because this Facebook account appears in search results, readers may mistakenly believe that the account is my official account as the author of The Turntable of Civilization.
There is also a danger that the account’s posts, photographs, personal relationships, and activities may be interpreted as my own words and conduct.
In fact, Google and other search engines have displayed search results in which information or images from the Facebook account in question have been associated with information about the author of The Turntable of Civilization.
This is a grave matter that damages my honor, credibility, identity and moral rights as an author, and the authenticity of The Turntable of Civilization.
The Facebook impersonation is not an accidental event that can be separated from the earlier search interference and defamation.
We understand the search interference that began immediately after the 2011 publication announcement, the creation of a large number of blogs using hundreds of IDs, the unauthorized reproduction of my writings, the defamatory Twitter statements describing me as an “unscrupulous author” and an “unscrupulous real estate broker,” and the Facebook account using the name “Akutagawa Kenji(芥川賢治)” that appeared around November 2017 to constitute a continuous series of harmful acts.
Meta is one of the world’s largest Internet companies, handling the names, photographs, biographies, personal relationships, and statements of people throughout the world.
Meta itself states that it does not permit accounts that impersonate other people.
Despite this, allowing an account that uses a real author’s pen name without permission and is strongly suspected of being connected with an individual who previously defamed that author to remain active for many years appears clearly inconsistent with Meta’s stated principles of authenticity, safety, and user protection.
In light of the above, I formally request that Meta investigate and respond to the following matters.
First, please investigate the Facebook account or profile using the name “Akutagawa Kenji(芥川賢治),” including when it was created, its name-change history, profile-change history, identity-verification status, and actual manner of operation.
Second, based on the evidence that we submit, please determine whether the account constitutes impersonation through the unauthorized use of the former pen name of Mikio Kisara, the author of The Turntable of Civilization.
Third, please examine the connections among the blogs, Twitter accounts, posting records, and Facebook profile that we identify from 2011 onward, and investigate the possibility that the Facebook account was created or managed by the individual responsible for the series of search-interference and defamatory acts.
Fourth, in preparation for future legal proceedings and inquiries from investigative authorities, please preserve the account’s registration information, email addresses and telephone numbers used, login records, connection-source information, device information, name-change history, profile-change history, posting history, deletion history, message records, and records of related accounts.
Fifth, please investigate whether there are any Facebook Pages, Instagram accounts, Messenger accounts, or other related accounts on Meta’s services that may be managed by the same individual.
Sixth, if impersonation is confirmed, immediately suspend or delete the account and take the necessary steps to update any profile information, images, cached data, and related displays that remain in search-engine results.
Seventh, please take measures to prevent the same individual or related persons from creating similar impersonation accounts by making slight changes to the name, spelling, images, or description.
Eighth, please investigate whether the account has been used for organized impersonation, harassment, search interference, dissemination of false information, or conduct intended to damage my copyrighted works or social credibility.
Ninth, if Meta has previously received reports concerning this account, please disclose when those reports were received, the decisions made, and the reasons why no action was taken.
Tenth, if the police, a court, or another lawfully authorized institution submits an inquiry or a request for preservation of records, please preserve and provide the necessary records in accordance with applicable law.
Eleventh, please provide a specific written response, rather than a standardized form reply, stating whether an investigation was conducted, whether the account was determined to be an impersonation account, which related accounts were identified, what measures were taken, and what measures will be implemented to prevent recurrence.
I ask Meta the following question.
Meta has grown into one of the world’s most powerful corporations on the basis of people’s names, photographs, identities, writings, and social credibility.
Is it right, either as a matter of basic human conduct or corporate responsibility, for Meta to leave unaddressed the theft of another person’s pen name and the impersonation of that person, even after evidence has been presented?
Freedom of expression does not mean the freedom to deprive another person of his identity.
The freedom to speak anonymously does not mean the freedom to steal another person’s name, biography, or status as an author.
Leaving impersonation unaddressed is not neutrality.
It allows the victim to continue suffering and provides the place and means through which the harmful conduct can continue.
Since July 16, 2010, I have continued writing and publishing The Turntable of Civilization without compensation, with the purpose of delivering truthful words for the benefit of Japan and the world.
In 2011, I suffered a serious illness and was told that my probability of survival was approximately 25 percent.
After approximately eight months in hospital, I survived.
Thereafter, I resolved to use all the intelligence, experience, and life that had been given to me for the benefit of Japan and the world, and I have continued writing The Turntable of Civilization.
I am currently preparing to ensure that this undertaking continues for the next 170 years and is passed on in a proper form to an outstanding younger generation.
To achieve that purpose, acts of impersonation that steal the author’s name, create confusion concerning the author’s identity, and corrupt search results must be completely eliminated.
I am not asking Meta for special treatment.
I am asking Meta to apply its own stated principles of authenticity, safety, and user protection honestly and faithfully to actual harm.
I strongly urge Meta not to leave this matter unaddressed, but to act as a corporation representing the world by conducting a prompt and impartial investigation, preserving the evidence, and implementing corrective measures.
